ThecurrentlegislationofUkraineprovidesthatforeignersandstatelesspersonswhopermanentlyresideinUkraine, aswellasthosewhohavebeengrantedrefugeestatusinUkraine, havetherighttoworkatenterprises, institutionsandorganizationsorengageinotherlaboractivitiesonthegroundsandintheorderestablishedforcitizensofUkraine.
Atthesametime, itshouldbenotedthattheLawofUkraine "OnEmploymentofthePopulation" definessomefeaturesofemploymentofforeignersandstatelesspersons. Thus, Article 42 stipulatesthatemployershavetherighttoemploythelaborofforeignersandstatelesspersonsontheterritoryofUkraineonthebasisof a permitissuedbytheterritorialbodiesofthecentralexecutivebodythatimplementsstatepolicyinthefieldofpopulationemploymentandlabormigration.
! Atthesametime, theLawprovidesforanexclusivelistofcategoriesofforeignerswhocanworkwithoutanemploymentpermit, inparticular:
- foreignerspermanentlyresidinginUkraine (onthebasisof a permanentresidencepermit);
- employeesofforeignrepresentativeofficesregisteredinaccordancewiththeestablishedprocedure;
- refugeeswhoreceivedpermissiontoimmigrate;
- employeesofforeignmassmediaaccreditedtoworkinUkraineandothers.
Itisworthpayingattentionthatthedutytopreparedocumentsforobtaining a permittousethelaborofforeignersrestswiththeemployerwhoinvites a foreigncitizentowork.
ThesepermitsareissuedbyterritorialbodiesoftheStateEmploymentServiceintheregionswheretheemployersarelocated.
Toobtain a permit, theemployersubmitsthefollowingdocuments:
1) a statementinwhichtheemployerconfirmsthat, accordingtothelawsofUkraine, thepositioninwhichtheworkof a foreigneror a statelesspersonwillbeemployedisnotrelatedtobelongingtothecitizenshipofUkraineanddoesnotrequireaccesstostatesecrets;
2) copiesofthepagesofthepassportdocumentof a foreigneror a statelesspersonwithpersonaldata, togetherwith a translationintoUkrainian, certifiedinaccordancewiththeestablishedprocedure;
3) a colorphotographmeasuring 3.5 x 4.5 cm;
4) a copyofthedraftemploymentcontract (contract) with a foreignerorstatelessperson, certifiedbytheemployer.
Inpractice, manyrefusalstoissueanemploymentpermitarerelatedto a poorlydrafteddraftemploymentcontract (contract). Theemploymentcontract (contract) mustcontaintheessentialtermsoftheemploymentcontractestablishedbythelegislationofUkraine, inparticular: thepositionoftheemployee, therightsandobligationsofthepartiestotheemploymentrelationship, wages (theamountoftheminimumwageof a foreignworker), thelengthofworkinghours, vacation, etc.
Thedecisiontoissue a permitismadewithin7 workingdays.
Forwhatperiodis a foreigner'semploymentpermitissuedandcanitbeextended?
Therefore, thepermitisissuedforthefollowingterm:
◦ validityoftheemploymentcontract (contract), butfornomorethanthreeyears - forspecialcategoriesofforeignersandstatelesspersons, definedinPart 2. Article 42-1 oftheLawofUkraine "OnPopulationEmployment";
◦ validityoftheagreement (contract) concludedbetweenUkrainianandforeigneconomicentities, butfornomorethanthreeyears - forsecondedforeignworkers;
◦ theeffectsofthedecisionof a foreignbusinessentityonthetransferof a foreignerorstatelesspersontoworkinUkraineandthecontractconcludedbetween a foreigneror a statelesspersonand a foreignbusinessentityontransfertoworkinUkraine - forintra-corporateassignees;
◦ validityoftheemploymentcontract (contract), butfornomorethanoneyear - forallotherforeignemployees.
Iftherearereasons, thevalidityofthepermitcanbeextendedanunlimitednumberoftimes.
Theemployermayindicateintheapplicationfortheissuanceof a permit a shortertermthanthatestablishedbythisLaw. Itisnotallowedtoissue a permitfor a shorterperiodthanspecifiedintherelevantapplicationandwithinthetimelimitsestablishedbythisLaw.
Fee for issuing a permit.
The employer shall pay the fee within 10 working days from the date of receipt of the decision to issue or extend the validity of the permit, which is sent by the territorial body of the State Employment Service by mail with a notice of delivery.
The amount of the fee for issuing or extending the validity of the permit is:
1) for permits issued for a period of one to three years or their validity is extended for such a period - six subsistence minimums for able-bodied persons established by law on January 1 of the calendar year in which the employer submitted the documents;
2) for permits issued for a period of six months to one year inclusive or their validity is extended for such a period - four subsistence minimums for able-bodied persons, established by law on January 1 of the calendar year in which the employer submitted the documents;
3) for permits issued for a period of up to six months or their validity is extended for such a period - two subsistence minimums for able-bodied persons, established by law on January 1 of the calendar year in which the employer submitted the documents.
After the expiration of the permit to use the labor of a foreigner, the employer returns such permit to the employment center.
Responsibility.
ThelegislatorprovidedresponsibilitynotonlyforallowingUkrainiancitizenstoworkwithout a legalbasis, butalsoresponsibilityforallowing a foreigncitizentoworkwithout a correspondingpermit. Inparticular, iftheemployeremploysforeignersorstatelesspersons:
• onthetermsofanemploymentorothercontractwithout a permitfortheemploymentof a foreigneror a statelessperson, a fineintheamountoftwentytimestheminimumwageestablishedatthetimeofdiscoveryoftheviolationforeachemployeeischarged;
• onconditionsotherthanthosestipulatedbythePermit - a fineischargedforeachpersonintheamountoftentimestheminimumwageestablishedatthetimeofdiscoveryoftheviolation.
