The procedure for issuing a license for tour operator activities, the list of requirements that must be fulfilled by entities that conduct tour operator activities, is defined in the Licensing conditions for conducting tour operator activities, approved by Resolution of the Cabinet of Ministers of Ukraine No. 991 dated November 11, 2015.

 

This license gives its owner the exclusive right to provide services related to the preparation of documents for departure outside Ukraine, as well as the right to use the word "tour operator" in the name.

 

The license conditions define that tour operator activity is the activity of tour operators in the organization and provision of the creation of a tourist product, implementation and provision of tourist services for outbound, inbound and domestic tourism.

           

! A tourist operator can only be a legal entity that carries out exclusively the following types of activities:

- organizing and ensuring the creation of a tourist product;

- implementation and provision of tourist services;

- intermediary activity regarding the provision of characteristic and related services, and which in the prescribed manner received a license for tour operator activity.

 

Since the licensing of travel agencies has been canceled a long time ago, the tour operator can also carry out travel agency activities (having previously selected the necessary type of activity according to KVED).

To obtain a license, a subject of tour operator activity submits an application and a list of supporting documents to the State Tourism Development Agency of Ukraine (DART).

 

To obtain a license, the subject must meet organizational, personnel and technological requirements, in particular:

- personnel requirements: the head of the tour operator must have a higher education, which is confirmed by a document on higher education, work experience in the field of tourism for at least three years or a higher education in the field of tourism, which is confirmed by a relevant document. If the director does not have the appropriate education, but has work experience in this field for at least 3 years, then this requirement is met;

- financial security (to cover one's responsibility for damages that may be caused to the tourist in the event of insolvency or as a result of violation of the bankruptcy process) - the minimum amount of which is at least 20,000 euros.

 

The license for tour operator activity is issued within 10 working days from the date of receipt of the application and is valid indefinitely.

An administrative fee is charged for the issuance of a license - in the amount of 1 subsistence minimum, effective on the day the licensing authority makes a decision to issue a license (payment is made no later than ten working days from the date of publication of the decision to issue a license on the official website).

 

LIST OF DOCUMENTS NECESSARY FOR OBTAINING A LICENSE FOR TOUR OPERATOR ACTIVITIES:

1) statement;

2) a document confirming the financial provision of civil liability to tourists;

3) copies of documents confirming the educational and qualification level, work experience of the manager of the license applicant (defined in Clause 10 of the Licensing Terms);

4) information on places of tour operator activity and their accessibility for groups of the population with limited mobility;

5) a contract with an insurance company on mandatory (medical and accident) insurance for tourists traveling on tourist trips;

6) a document confirming the right to use the premises in which the tour operator will conduct its activities.
