AccordingtotheConstitutionofUkraine, foreignersandstatelesspersonswhoareinUkraineonlegalgroundsenjoythesamerightsandfreedomsandbearthesameobligationsascitizensofUkraine.

Thismeans, inparticular, thattheycanworkforhireorstarttheirownbusiness. However, quiteoftenitisnoteasyforanaverageforeignertogothroughallstagesofthepermitproceduresontheirown. Therefore, itisveryimportantinthismattertoenlistthesupportofexperiencedspecialists, whoarethelawyersofourlawfirm.

 

AccordingtothelawsofUkraine, thelegalgroundsforthestayof a foreigncitizenontheterritoryofUkraine, whichisoneofthemainrequirementsforregistering a foreigncitizenas a private entrepreneur, are:

- visa - forcitizensofcountrieswithwhichthevisaregimeapplies;

- a noteaboutcrossingtheborder - forcitizensofcountrieswithwhichUkrainehasestablished a visa-freeregime;

- a permit (forpermanentortemporaryresidence).

 

TheprocedurefortheregistrationofindividualentrepreneursinUkraineisregulatedbythelaw "OnStateRegistrationofLegalEntities, IndividualEntrepreneursandPublicOrganizations", whichdoesnotdistinguishbetweentheprocedureforregisteringanentrepreneuras a citizenofUkraineor a foreigncitizen.

 

A foreignermustcomplywiththefollowingconditionsforthiscase:

- have a registeredplaceofresidence (registration);

- haveanidentificationnumber (receivedfromthetaxofficewithin 3 workingdays).

 

Ingeneral, inordertoregisterasanentrepreneur, a foreigncitizenmustfillout a registrationapplicationoftheestablishedform, whichindicatesinformationabout:

1. surname, firstname, patronymic, passportdataoftheapplicant;

2. identificationnumber;

3. typesofeconomicactivityaccordingto KVED.

 

Ifthedocumentsaresubmittedbylawyersofourcompany, then a notarialpowerofattorneymustbecertifiedtorepresentinterestsbeforethestateregistrar.

! Wedrawyourattentiontothefactthatwhensubmitting a powerofattorneyfortherepresentationofintereststo a notarypublic, youmustpresent a documentcertifyingthelegalityoftheforeigner'sstayontheterritoryofUkraine (certificate).
